Defective Products

In Arizona, defective products are those products designed in such a way that the positive features of the design are outweighed by the harmful and negative features of the design. When this happens, serious injury – including sever burns – often occur.

For example, a heater core in a car holds hot water from the radiator and is used to heat the car.  It is positioned in the dashboard over the brakes.  A large car manufacturer decided to change the material making up the heater core in some of their cars from copper to a plastic composite.  This saved the manufacturer a little bit of money and conferred no advantages over the prior design, but a significant number of the heater cores would crack after a couple of years, spraying scalding water onto the legs of the driver while the car was in operation.

When the Burn Injury Lawyers took the case, the car manufacturer had settled a dozen of these cases quietly for less than $20,000.  We exposed what they were doing and settled three of these cases, involving severe leg burns, for more than half a million dollars.

Consumer Product Safety Commission Recalls Due To Fire Hazard

Fire and burn hazard are some of the most common reasons that the CPSC recalls dangerous and defective products.  Here is a sampling of recalls from March and April of 2014 alone:

Dyson Recalls Bladeless Portable Electric Heaters Due to Fire Hazard

The heaters can develop an electrical short and overheat, posing a fire hazard to the consumer. Dyson is aware of 82 incidents of the recalled heaters short-circuiting and overheating, including four reports of heaters with burned or melted internal parts. No injuries or property damage have been reported, but the recall affects about 338,000 units in the U.S.

Hussong Manufacturing and American Flame Recall Three Gas Fireplaces Due to Explosion Hazard

This recall involves Hussong Manufacturing gas fireplaces and gas fireplace inserts that use American Flame brand main control modules. Hussong Manufacturing received reports of nine incidents of gas being released prematurely and exploding, resulting in minor property damage and two reports of abrasions.

Centex Homes Recalls Solar Panels Due to Fire Hazard

Two incidents in which roof fires originated in or near the recalled roof panels have been reported. These incidents involve homes sold by Centex. No injuries have been reported.

Ace Hardware Recalls LED Clamp Light Due to Shock and Fire Hazard

The cord bushing inside the light base can fail, allowing the cord wiring to pull out of the base leading to exposed wiring and presenting a significant shock and fire hazard.

Wal-Mart Recalls Dolls Due to Burn Hazard

The circuit board in the chest of this children’s doll can overheat, causing the surface of the doll to get hot, posing a burn hazard to the children. Wal-Mart has received at least 12 reports of incidents, including two reports of burns or blisters to the hand.

L.L. Bean Girl’s Pajamas Recalled Due to Violation of Flammability Standard

The children’s pajama sets fail to meet the federal flammability standard for children’s sleepwear, posing a risk of burn injuries to children.
